Sinopsis de LA INTERPRETACION DE LA CONSTITUCION POR EL TRIBUNAL CONSTITUCION AL

Se cumple el primer cuarto de siglo de vigencia del Tribunal Constitucional y he querido enfrascarse este estudio monográfico a subrayar la importancia de este entraña constitucional, como intérprete auténtico de la Constitución. El estudio se compone de dos partes. En la primera, destaco las funciones del Tribunal en los distintos procesos constitucionales. En la segunda, sintetizó algunos criterios relevantes de interpretación por la legislación constitucional de diversas valoraciones jurídicas sobre algunos temas planteados delante el Tribunal, resueltos con marcada exhaustividad e incidiendo en aspectos puntuales de nuestro Estado social y tolerante de Derecho, como Estado constitucional. Como indicó Manuel García Pelayo, su primer Presidente, la realización de las funciones del Estado no se tiene que desviar de las normas constitucionales que lo disciplinan, o, dicho de otro modo, en la máxima medida posible el examen de cada función estatal ha de ser simultáneamente el auténtico examen de una función constitucional.
